OFFICIAL RULES AND TERMS

Sponsor and Promotion: The AMD Philippines Christmas Treat Promotion (“Promotion”) is sponsored by Advanced Micro Devices, Inc., 2485 Augustine Dr., Santa Clara, CA 95054 (“AMD” or “Sponsor”).

PROMOTION IS VALID ONLY DURING THE SUBMISSION PERIOD WHILE SUPPLIES LAST. PARTICIPANTS WILL NOT BE ALLOWED TO OBTAIN A PRIZE AFTER ALL PRIZES HAVE BEEN DISTRIBUTED.

Eligibility: The Promotion is open only to persons who arelegal residents of the Philippines who are at least 18 years of age (or at least the minimum age of majority in their place of residence, whichever is greater) as of the start of the Submission Period (defined below), and who submit a valid Submission (as defined below) (“Participant”).

Agreement to Official Rules and Terms: Participation in the Promotion constitutes Participant’s full and unconditional agreement to, and acceptance of, these Official Rules and Terms which are final and binding.

Submission and Submission Period: The Promotion will start on November 20, 2023, and end December 17, 2023 (“Submission Period”). Sponsor’s computer systems will be the official timekeeping device for the Promotion.

During the Submission Period, Participant must:

purchase a laptop configured with a select, Eligible AMD Processor from an Eligible Philippines-based Retailer located in the Philippines (seeTable A above);and
submit an email to promo@mkrhk.com with the subject line of “Christmas Treat” with following information/attachment(s):
- Participant’s full name, delivery address, phone number;
- the eligible AMD processor the Participant within the laptop they purchased;
- the name of the eligible Philippines-based retailer where Participant purchased the laptop with the eligible AMD processor; and
- the date Participant purchased the laptop with the eligible AMD processor; and
- an attachment (scanned copy or photo) of Participant’s sales invoice or receipt showing clearly both the purchase of the laptop containing the eligible AMD processor and eligible Philippines-based retailer.

Failure to include the above required information will void the Submission.

Prize Notification and Delivery: Within thirty (30) business days of AMD receiving a valid Submission email in accordance with the above these Official Rules and Terms, AMD will deliver to Participant one (1) PHP 1000 Sodexo Gift Certificate while supplies last (“Prize”) at the address Participant provided Sponsor in the Submission. This Promotion is not valid in conjunction with any other promotion, program, or discount.

For All Prizes: Sponsor reserves the right to substitute a prize of equal or greater monetary value if the prize, or any component of the prize, cannot be awarded for any reason. Sponsor is responsible only for shipping of the prize; not responsible for prize utility, quality or otherwise. Once a prize is shipped and/or delivered to the winner, Sponsor is not responsible for any prize that is lost, stolen, mutilated, destroyed, misdirected, or undelivered for any reason. Sponsor will not replace any lost or stolen prize items. Taxes and fees, if any, are the sole responsibility of prize winners.

Release: By participating, Participant agrees to release and hold harmless Sponsor, and each of its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize.

Privacy: Except as set forth herein, all information submitted by Participants in the Promotion will be treated according to the Sponsor’s Privacy Policy at https://www.amd.com/en/corporate/privacy.

General Conditions: Sponsor reserves the right to terminate, amend, suspend or modify this Promotion in whole or in part, at any time and without notice or obligation, if in Sponsor’s sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules and Terms. Sponsor’s failure to enforce any term of these Official Rules and Terms shall not constitute a waiver of that provision or of any other provision of these Official Rules and Terms. The invalidity or unenforceability of any provision of these Official Rules and Terms shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules and Terms is determined to be invalid or otherwise unenforceable, then the Official Rules and Terms shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

Limitations of Liability: Sponsor is not responsible, and Participant hereby releases and indemnifies Promoter for: (i) invalid, incorrect, or unreachable email addresses or contact information provided by Participant; (ii) lost, late, incomplete, invalid, altered, unintelligible or misdirected submissions; (iii) any technical, hardware, software, server, website, or other failures or damage of any kind to the extent that Participant is prevented from participating in the Promotion; and(iv) any tax liability, if any, which is the sole responsibility of, and must be paid by, Participant.

Sponsor is not bound by and will not be liable for any statement by any Eligible Philippine-based Retailer in conflict with these Official Rules and Terms including, but not limited to, statements regarding Prize delivery.

Disputes: Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in Santa Clara County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Terms, or the rights and obligations of the Participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Some jurisdictions do not allow for limitations of certain remedies or damages and so this provision may not apply to you.
