Sponsor: Advanced Micro Devices, Inc., 2485 Augustine Drive, Santa Clara, CA 95054, United States (“AMD”).

Purchase Period: June 1 to 30, 2024

To Participate:

During the Purchase Period, Participants must purchase a laptop configured with a select AMD Ryzen™ processor from Octagon Computer Store, Silicon Valley, PC Express, and Villman Computer branches nationwide, and provide a valid, dated, and legible purchase receipt in order to receive one (1) AMD Limited Edition Hoodie, 600 pcs Hoodies to be given.

• Provide all requested information, including a valid and legible sales receipt from the Retailer by sending an email to promo@mkrhk.com with the Subject Line: Mid Year Offer. Participant must include their Full Name, Delivery Address, Valid Phone Number, Eligible AMD Processor (purchased by the Participant), Name of the Retailer, Date of Purchase, and a dated Proof of Purchase (A scanned copy or photo of the Participant’s Sales Invoice or Official Receipt) as an attachment to the email.
• Product purchase time must correspond to the purchase period.
• Configuration information of a system or a device is in accordance with the rules of the promotion program.
• Allow AMD 5-10 working days from the date of your email to verify the product purchase.
• Not valid in conjunction with any other promotions, programs, or discounts.

ELIGIBLE PRODUCTS

Release: By participating, Participant agrees to release and hold harmless AMD and each of its respective subsidiaries, affiliates, suppliers, distributors, advertising agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the AMD Summer Bundle Promotion.

 Privacy: The Participants acknowledges and understands that all personal information submitted as part of this offer will be collected and processed by the administrator for the purpose of managing the Promotion in accordance with AMD’s privacy policy.

General Conditions: AMD reserves the right to terminate, amend, suspend, or modify the Promotion in whole or in part, at any time and without notice or obligation, if in AMD’s sole discretion, any factor interferes with its proper conduct as contemplated by these Terms and Conditions. Without limiting the generality of the foregoing, if, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of AMD which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, and AMD reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, AMD reserves the right to seek damages from any such person to the fullest extent permitted by law. AMD’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision or of any other provision of these Terms and Conditions. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision of the Terms and Conditions is determined to be invalid or otherwise unenforceable, then the Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

Limitations of Liability: The Released Parties are not responsible, to the extent permitted by law, for: (1) any incorrect or inaccurate information, whether caused by Participant, printing errors or omission or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of Entries; or (5) any injury or damage to person or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason a Participant’s Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is another Entry in the Promotion provided that if it is not possible to submit another Entry due to discontinuance of the Promotion, or any part of it, for any reason, AMD, at its discretion, may elect to hold a random drawing from among all Eligible Entries or, as the case may be, received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules and Terms to be available and/or claimed AMD reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

 NOTHING IN THESE OFFICIAL RULES AND TERMS SHALL DISCLAIM, LIMIT, OR EXCLUDE LIABILITY FOR ANY LIABILITY THAT MAY NOT BE DISCLAIMED, LIMITED, OR EXCLUDED PURSUANT TO APPLICABLE LAW.

Disputes: Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Texas or the appropriate Texas State Court located in Travis County, Texas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Terms, or the rights and obligations of the Participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas. Some jurisdictions do not allow for limitations of certain remedies or damages and so this provision may not apply to you.
